Nature’s Own Cosmetics (NOC Cosmetics)

1. General Regulatory Responsibility

Nature’s Own Cosmetics operates as a private label manufacturer. The private label customer (the “Brand Owner”) is the legal entity placing the product on the market and is therefore responsible for regulatory compliance in the country or region where the product is sold.

While NOC Cosmetics manufactures products in accordance with applicable cosmetic manufacturing standards, the Brand Owner assumes full responsibility for:

  • Product registration (where required)

  • Regulatory filings and notifications

  • Label compliance

  • Marketing claims compliance

  • Product liability insurance

  • Market-specific documentation


2. Canada Compliance

In Canada, cosmetics are regulated under Health Canada pursuant to the Food and Drugs Act and Cosmetic Regulations.

Brand Owner Responsibilities:

  • Filing a Cosmetic Notification Form (CNF) within required timelines NOC Already does this for each product

  • Ensuring ingredient compliance with the Cosmetic Ingredient Hotlist

  • Maintaining product safety substantiation

  • Ensuring compliant labeling (INCI names, bilingual requirements, net quantity, etc.)

NOC Cosmetics can provide ingredient lists and supporting documentation upon request; however, regulatory filings remain the responsibility of the Brand Owner.


3. United States Compliance

In the United States, cosmetics are regulated by the U.S. Food and Drug Administration (FDA) under the Federal Food, Drug, and Cosmetic Act and the Modernization of Cosmetics Regulation Act (MoCRA).

Brand Owner Responsibilities:

  • Facility and product listing (if required under MoCRA)

  • Ensuring product safety

  • Proper ingredient declaration (INCI format)

  • Compliant labeling and claims

  • Maintaining adverse event reporting procedures

  • Ensuring products are not marketed as unapproved drugs

NOC Cosmetics manufactures products to cosmetic standards; however, final labeling, claims, and regulatory positioning are the responsibility of the Brand Owner.


4. European Union (EU) Compliance

Cosmetics sold in the EU are regulated under Regulation (EC) No 1223/2009.

NOC Cosmetics:

  • Is not EU registered

  • Does not act as an EU Responsible Person

  • Does not complete CPNP registrations on behalf of customers

Brand Owner Responsibilities:

  • Appointing an EU Responsible Person

  • Completing registration through the Cosmetic Products Notification Portal (CPNP)

  • Obtaining the required EU notification number

  • Preparing a Product Information File (PIF)

  • Completing a Cosmetic Product Safety Report (CPSR)

  • Ensuring full EU-compliant labeling

While many NOC formulations are developed using EU-permitted ingredients, regulatory registration and documentation are the sole responsibility of the Brand Owner.

Once EU registration details are obtained, NOC Cosmetics can print:

  • EU Responsible Person information

  • Required EU labeling statements

  • EU notification numbers

  • Other mandatory regulatory text


5. Labeling & Claims Responsibility

The Brand Owner is fully responsible for:

  • All marketing claims (e.g., “organic,” “medical,” “dermatologist tested,” etc.)

  • Ensuring claims do not classify the product as a drug or therapeutic product

  • Compliance with advertising laws in the jurisdiction of sale

  • Trademark and intellectual property clearance

NOC Cosmetics is not liable for non-compliant claims added by the Brand Owner.


6. Insurance Requirement

Private label customers are strongly encouraged to maintain:

  • Product Liability Insurance

  • General Commercial Liability Insurance

Under their own company name.

NOC Cosmetics’ insurance policy does not extend coverage to private label brands or their end customers.


7. Indemnification

The Brand Owner agrees to assume full regulatory and legal responsibility for products placed on the market under their brand name and agrees to indemnify and hold harmless Nature’s Own Cosmetics from claims arising from:

  • Improper registration

  • Non-compliant labeling

  • Unauthorized claims

  • Failure to obtain required insurance

  • Market-specific regulatory violations


8. Regulatory Disclaimer

Nature’s Own Cosmetics manufactures cosmetic products for private label use. We do not provide legal or regulatory advisory services. Brand Owners are advised to consult qualified regulatory professionals or legal counsel before distributing products in any jurisdiction.
